When does the disqualification begin? Because the sentence is under two
years, he will only be required to serve 11 months. That means a
four-month ban if the disqualification doesn't begin upon release.

Of course he will serve 22 months, it's just that some of it will be in
custody and the rest on licence.

With his type of offence it could well be that he gets to an open prison
very quickly, in which case he could well have been able to drive once
he is allowed to do outside work - or on the specific days when he is
given day release. The ban would obviously remove that possibility.

It is also quite likely that he would be released well before 11 months
on HDC - the 'tag'. In which case his driving ban could have quite an
impact.

Furthermore, he is likely to find his insurance premiums have increased
significantly when he does try to get back behind the wheel, so he
hasn't got away too lightly overall - not that I sympathise with his
recklessness in any way.

But banning him from driving won't stop him driving, prison will, at
least for a while:

inside the car.

Wiltshire Police said he later admitted charges of dangerous driving,
failing to stop, possession of cannabis, driving without a licence and
driving without insurance."

Tag him. In this day and age. It should be possible to track potential
criminals. If the track shows him in a car, he needs to be able to say
who was driving.

OK, if he won't stop driving prison is a final solution, but he should
have been banned for life first, car confiscated etc.

He'd be bang to rights on failing to stop (as long as that was what he'd
done), possession of cannabis, driving without a licence and driving
without insurance, but of what would the alleged dangerous driving consist?

It was held in court years ago that exceeding the speed limit is not, of
itself and absent other hazards and hazardous circumstances, prima facie
evidence of dangerous driving.

The fact that danger is arguably caused is not the same as dangerous
driving.

I wonder whether he sought legal advice on the DD charge?

Well, not unless it causes the loss of his job and he has a family and a
mortgage to maintain.

That could cost £500 a week.

Driving at 140mph wasn't even an offence until the 70mph NSL was brought
in by Barbara Castle (who never learned to drive but apparently knew
everything there was to know about it).
